These Terms of Service ("Terms") govern your use of the Satwise mobile application (the "App"), operated by Fresh Take LLC, a Wyoming limited liability company ("Satwise," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.
If you do not agree, do not use the App.

1. Who can use Satwise
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or legal guardian's permission to use Satwise and to agree to these Terms.
By using Satwise, you represent that you are not barred from using the App under applicable law.
2. Your account
To use most features, you'll need to create an account with a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us promptly of any unauthorized use at legal@satwise.app.
One account per person. Don't share your account or sell access to it.
3. Subscriptions and payments
Satwise offers a free tier and optional Pro subscriptions. All Pro subscriptions are processed by Apple through your Apple ID.
Free tier
The free tier includes the diagnostic test, daily missions, basic practice questions across every topic, and Sir Cumfy's daily encouragements. No credit card required.
Pro subscriptions
Pro unlocks unlimited practice, AI hints on every question, full explanations, and adaptive difficulty. Available as Monthly, 3-Month, or 6-Month subscriptions, with a 7-day free trial for first-time subscribers.
Free trial
Your 7-day free trial starts when you subscribe. You won't be charged until the trial ends. Cancel any time during the trial through Apple's Settings → Subscriptions and you won't be charged.
Auto-renewal and cancellation
All subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. To cancel, open the iPhone Settings app → tap your name → Subscriptions → Satwise → Cancel.
Refunds
Refund requests are handled by Apple. We don't directly process refunds. Visit reportaproblem.apple.com to request one.
4. Acceptable use
You agree not to:
- Use Satwise for any unlawful purpose or in violation of these Terms.
- Attempt to reverse engineer, decompile, or extract the source code of the App.
- Use bots, scripts, or automated tools to access or scrape Satwise content.
- Share, distribute, or republish Satwise practice content without our written permission.
- Attempt to gain unauthorized access to any part of the App or its systems.
- Use Satwise to harass, abuse, or harm another person.
- Impersonate any person or misrepresent your affiliation with any person or entity.
5. Content and intellectual property
Satwise, including all practice questions, explanations, hints, the Sir Cumfy character, designs, logos, and code, is owned by Fresh Take LLC and protected by copyright, trademark, and other intellectual property laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own SAT preparation. You may not copy, modify, distribute, sell, or commercially exploit any part of the App without our written permission.
SAT is a registered trademark of the College Board. Satwise is not affiliated with, endorsed by, or sponsored by the College Board.
6. AI-generated content
Satwise uses artificial intelligence (currently powered by Anthropic's Claude) to generate hints, strategy explanations, and personalized coaching messages. AI-generated content can occasionally be incorrect, incomplete, or misleading.
You acknowledge that:
- AI hints and explanations are tools to help you learn — not infallible answers.
- You should verify important information against authoritative sources.
- We do not guarantee the accuracy of AI-generated content.
7. Termination
You can stop using Satwise and delete your account at any time through the App's settings or by emailing legal@satwise.app.
We may suspend or terminate your account if you violate these Terms, engage in fraud, or pose a risk to other users or to us. We'll provide notice where reasonably possible, but we may act immediately for serious violations.
If we terminate your account, you forfeit any unused subscription time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
8. Disclaimers
Satwise is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the App will be uninterrupted, error-free, or secure.
- Warranties that any information you obtain from Satwise will be accurate, complete, or up to date.
- Warranties of any specific outcome on the SAT or any other test.
Satwise is a study tool. It is not a guarantee of test performance. Your actual SAT score depends on many factors outside our control.
9. Limitation of liability
To the fullest extent permitted by law:
- In no event will Fresh Take LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of Satwise.
- Our total aggregate liability to you for any claim arising from or relating to these Terms or your use of Satwise will not exceed one hundred U.S. dollars ($100), regardless of the cause of action.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Dispute resolution and arbitration
Informal negotiation first
Before filing any claim, you agree to first try to resolve the dispute informally by emailing us at legal@satwise.app with a description of the issue and your contact information. We agree to do the same. We'll work in good faith to resolve the dispute for at least 30 days before either party initiates formal proceedings.
Binding arbitration
If informal negotiations fail, any dispute, claim, or controversy arising out of or relating to these Terms or your use of Satwise will be resolved by binding individual arbitration, not in court, except that you may bring claims in small-claims court if eligible.
Arbitration will be administered by a recognized arbitration service (such as the American Arbitration Association) under its consumer arbitration rules. The arbitration will be conducted in English, and judgment on the arbitration award may be entered in any court with jurisdiction.
Class action waiver
You and Satwise agree that disputes will be resolved on an individual basis only, not on a class, collective, or representative basis.
Time limit on claims
Any claim or cause of action arising out of or related to these Terms or your use of Satwise must be filed within one (1) year after the claim arose, or it will be permanently barred.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. Subject to the arbitration provisions above, the exclusive venue for any disputes that proceed in court will be the state and federal courts located in Sheridan County, Wyoming.
12. Changes to these terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date and, for material changes, notify you through the App or by email before the change takes effect. Your continued use of Satwise after the change means you accept the updated Terms.
